Business Terms

1. Introduction
These Business Terms ("Business Terms") govern your use of TrustDiner business accounts and business-facing tools operated by TrustDiner Ltd ("we", "us", "our"). They apply in addition to our general Terms & Conditions and Privacy Policy. Where these Business Terms conflict with the general Terms in respect of a business account, these Business Terms prevail. By creating a business account or using any business feature, you agree to these Business Terms.
2. Eligibility and Authority
By registering a business account you confirm that you are at least 18 years old and that you are authorised to act on behalf of the business, venue, hotel, chain, or location you represent. If you act for an organisation, you accept these Business Terms on its behalf and confirm you have authority to bind it.
3. Business Accounts
- Provide accurate, current business information (business name, your role, and contact details)
- Keep your login credentials secure and do not share them
- Do not impersonate another business, person, or role
- You are responsible for activity carried out under your account
4. Claiming and Verification
Claiming a venue or chain page does not transfer ownership of the listing to you. We may request reasonable evidence to verify your connection to a business and may approve, reject, suspend, or revoke a claim at our discretion, including where we suspect inaccurate, fraudulent, or unauthorised claims.
5. Allergen Information — Your Responsibility
Important Health & Safety Notice
You are solely responsible for the accuracy, completeness, and timeliness of any allergen, ingredient, and menu information you publish through TrustDiner, including disclosures about cross-contact and changes to recipes, suppliers, kitchen processes, or staff. You must keep this information up to date. TrustDiner displays the information you provide but does not verify, certify, or guarantee its accuracy and is not a substitute for direct confirmation with your kitchen.
6. Published Business Content
"Business Content" means any material you submit or publish through business tools, including menus, dishes, allergen data, business descriptions, logos, brand colours, images, menu QR codes, and responses to reviews. You confirm that you have the rights to publish your Business Content and grant TrustDiner Ltd a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute it on and in connection with the platform.
You must not publish content that is unlawful, misleading, infringing, defamatory, or that misrepresents allergen safety.
7. Menu QR Codes
Where TrustDiner generates QR codes that link to your published menu, you are responsible for how and where you display them and for ensuring the linked menu remains accurate and current. QR codes must not be altered to misrepresent their destination.
8. Responding to Reviews
When responding to diner reviews, your responses must be lawful and respectful. You must not harass, threaten, or retaliate against reviewers, and you must not disclose any customer's personal data or health information. Do not publish anything that identifies a reviewer beyond what they have chosen to share.
9. Acceptable Use
You agree not to:
- Submit false claims, fake reviews, or misleading allergen information
- Scrape, spam, or interfere with the platform or other users
- Upload malware or attempt to gain unauthorised access
- Use the platform for any unlawful purpose
10. Moderation and Removal
We may review, format, hide, remove, or suspend Business Content or accounts where we reasonably consider this necessary for safety, legal compliance, accuracy, or platform quality. Where practical and lawful, we will let you know why.
11. Subscriptions, Billing, and Payments
Some features are free and others require a paid plan. Where you purchase a paid plan:
- Payments are processed by our payment provider, Stripe; you authorise the charges shown at checkout
- Subscriptions renew automatically until cancelled, and you may cancel via your billing settings
- Fees are stated exclusive of any applicable taxes (e.g. VAT) unless otherwise indicated
- Failed or reversed payments may result in suspension of paid features
- Except where required by law, fees already paid are non-refundable
12. Feature Availability
We may add, change, limit, or remove business features, and may make features available only on certain plans or in certain regions. We aim to give reasonable notice of material changes that affect paid features.
13. Termination
You may close your business account at any time. We may suspend or terminate a business account that breaches these Business Terms or where required for legal or safety reasons. On termination, published Business Content may be removed or retained as described in our Privacy Policy and applicable law.
14. Liability
To the fullest extent permitted by law, TrustDiner Ltd is not liable for business losses (including loss of profits, revenue, goodwill, or anticipated savings), for reliance on community-sourced information, or for any loss arising from inaccurate allergen or menu information published by a business. Nothing in these Business Terms excludes liability that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify TrustDiner Ltd against claims, losses, and reasonable costs arising from your Business Content, your inaccurate allergen or menu information, your breach of these Business Terms, or your unauthorised use of a business account.
16. Governing Law
These Business Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
